PROCEDURE FOR TRADEMARK REGISTRATION
STEP 1: SEARCHES
Before a brand name is protected, the name or the intended mark MUST be sent to our Firm to conduct search for the availability of the trademark for registration in Nigeria. Also, a power of attorney will be provided to client to sign, stamped in other for the firm to proceed with the registration of the brand name upon the availability of the trademark.
STEP 2: CLASSIFICATION
The classes of the International Classification of goods and services will be applicable that is 1-45. The application is done per mark per class depending on clients intended products.
STEP 3: GENERAL
When a mark is applied for; after a successful search, Original signed and sealed Acknowledgement form and Acceptance letter will be received from the Federal Ministry of Trade and Investment Registry, Abuja Nigeria and it will be delivered to your office for record purposes.
- PUBLICATION: As soon as the Acknowledgement form and Acceptance letter is approved, signed and sealed by the Registrar of Trade Marks, the marks will be published in the Trade Marks Journal per class per mark which will be available to client based on request.
- DURATION: After three (3) months expiry period of the publication in the Trade Marks Journal and there are no opposition to the trademark, certificate will be applied for and issued, which means the Proprietor/Company owns the mark for 7 years from filing date and renew for further period of 14 years.
- ASSIGNMENTS: Assigning a trademark to another person or Company is permitted.
